On December 2, 2009, Edwin H. Howard (“Howard”) commenced this action against IKO Manufacturing, Inc. (“IKO”) in the Fitchburg Division of the District Court Department. Howard alleges that in September or October, 1990, he purchased shingles manufactured by IKO and applied them to his roof. He claims that the shingles came with a forty- or fifty-year warranty, but began to disintegrate in less than twenty years due to defects.
