MEMORANDUM AND ORDER

LUNGSTRUM, District Judge.

I. Introduction

Plaintiffs David Burton and Ora Burton filed this lawsuit on May 25, 1994, and later filed an amended complaint against defendants R.J. Reynolds Tobacco Company and The American Tobacco Company. Plaintiff 1 alleges numerous claims, including fraud and misrepresentation, negligence, strict liability, breach of express warranty, conspiracy and violation of consumer protection statutes.
