This suit, which was originally in the form of an ordinary action of trespass to try title, was brought on March 12, 1898, by the appellant T. M. Stroud, against the appellee H. P. Hawkins. On- January 25, 1899, the plaintiff filed an amended petition and made his sister, Ora Stroud, a party defendant. It was alleged in the amended petition that the land sued .for, which is a lot in Hillsboro, was inherited by the said T. M. and Ora Stroud from their mother when they were minors; that their father, E. B. Stroud, was the legally appointed and qualified guardian of…
