ORDER
ARCARA, District Judge.
The above-referenced case was referred to Magistrate Judge Leslie G. Foschio pursuant to 28 U.S.C. § 636(b)(1)(B), on October 4, 1995. On, September 12, 1997, Magistrate Judge Foschio filed a Report and Recom*204mendation, recommending that defendants’ motions to dismiss and for summary judgment be denied. Defendants filed objections to the Report and Recommendation, which were subsequently withdrawn.
