This is an appeal from an order of one of the circuit judges of the 3rd Judicial Circuit quashing a writ of habeas corpus and remanding the petititioner to the custody of the respondent chief of police. The petitioner in the court below, appellant here, was being held under a warrant issued by the Mayor of the Town of Perry, based upon an affidavit charging “that on the 25th day of September A.
