The following is the opinion of Speer, Circuit Judge, in the Circuit Court: In the early part of the year 1900 the Millen Cotton Mills undertook the erection and equipment of a cotton factory at Millen, Ga. The company purchased a tract of land, constructed mill buildings, and on various dates during that year made contracts for the purchase and installation of appropriate machinery.
