—Order, Supreme Court, New York County (Louise Gruner Gans, J.), entered July 12, 1999, which, inter alia, denied defendant’s motion for summary judgment dismissing the complaint and denied her motion for a protective order, unanimously modified, on the law and the facts, to dismiss plaintiffs causes of action for intentional infliction of emotional distress and violations of the Executive Law and to direct that depositions proceed under the supervision of a Special Referee to be paid for equally by the parties, and otherwise affirmed, without costs.
