Defendants are a group of related companies that were in the business of producing and selling phosphate products from various locations in Canada, Mexico and the U.S. In early 2004, an agency of the Government of Mexico, the Comisión Nacional del Agua (National Water Commission [CNA]), began an audit of the water usage of defendants’ operation in Mexico—Rhodia Fosfatados de Mexico, S.A. de C.V In March 2004, the CNA sent a letter to Rhodia Fosfatados’s legal representative in Mexico that advised the company of the audit and requested information and…
