GALLAGHER, Chief Justice.
Appellee, Windol W. Matthews, on November 28, 1932, sued appellant, J. M. Radford Grocery Company, a corporation, in trespass to try title to recover a tract of land 100x150 feet in the town of Dawson, which tract he described by metes and bounds. Appellant disclaimed as to an undivided one half interest in the tract and claimed title to the other half interest under attachment, judgment of foreclosure, and purchase at constable’s sale under process issued on such judgment in a suit by it against Leo P.
