This action is brought by a citizen of the state under section 4 of the Labor Law to procure the cancellation of a contract entered into between the .city of New York and the defendant Thompson-Starrett Company for the construction of the new municipal building in the borough of Manhattan and to restrain the defend-, ant Prendergast from making any payments thereon. The defendant contractor sublet the granite work to the Mount Waldo Granite Works, a Maine corporation.
