The Mouat Lumber Company brought this action to foreclose a mechanic’s lien filed in August, 1893, by Palmer as their assignee, under a general assignment for the benefit of creditors. It presents numberless questions and in the exercise of their professional right and the performance of their duty, counsel have argued them with much zeal and ability, and ordinarily would have the right to insist on'a decision of the propositions which they present in so far as they were necessarily involved.
