OPINION

TOMLJANOVICH, Justice.

A jury on May 23,1995 convicted appellant Brett Randall Walen of the first-degree murder of Keith Eugene Wallace, Jr. Walen filed a notice of appeal on August 21,1995 arguing only that the evidence adduced at trial was insufficient as a matter of law to sustain his conviction. Walen subsequently requested posteonviction relief on two additional grounds — denial of his right to testify and ineffective assistance of counsel — and moved this court to stay the direct appeal.
