delivered the opinion of the court.
The plaintiff, as beneficiary under a life insurance policy, obtained a judgment against the insurer, based upon and enforcing a double liability provision in the policy. The sole question before this court is the proper construction of an exclusion clause, which read as follows:
“There shall be no liability on the part of the company under the double indemnity benefit of the policy if the death of the insured results from suicide while sane or insane or from submarine diving or aeronautic operations as a passenger or otherwise, or…
