Plaintiffs, Earl Morgan and Frederic J. Saetelle, are electricians who were seriously injured when they fell from a rolling scaffold which toppled over after one of its wheels fell into a hole in a building under construction. They each filed an action against Associated Construction and Engineering Co. (Associated), the general contractor for the building, and two individuals doing business as Able Equipment Rental (referred to collectively as Able), which rented the scaffold to plaintiff’s direct employer, Aaron Electric Company (Aaron).
