ORDER GRANTING IN PART AND DENYING IN PART DEFENDANT’S MOTION

BACKGROUND

KAY, District Judge.

On April 19, 1992, the decedent, eleven year old Joshua Covington, accompanied Staff Sergeant Dennis Warren and his family to Bellows Air Force Station beach for an outing. The portion of the beach Joshua and the Warrens visited is closed to the general public. Although there is no admission charge to the beach area, the Warrens paid a charge for use of the picnic area behind the beach.
