1. On the trial of an action for damages on account of injuries alleged to have been received by a passenger in attempting to alight from a railroad-train that had not stopped at the destination of the passenger a sufficient length of time for the passenger to alight from the train, it was error for the court to charge the jury as follows: “In the event you find that this plaintiff left the train without sufficient excuse for leaving it while in motion, and that she was warned not to do so, and that her leaving the train was without justification upon her part, she would not be entitled to…
