I. Procedural Background
This matter is now before the court on Universal’s objections to the recommendation of the Magistrate Judge that Hale Intermo-dal Marine Company (“Hale”) be granted summary judgment in its claim against Universal Maritime Service Corporation (“Universal”) for indemnity arising out of a fire on a barge on April 15, 1994.
