Nelson, Justice.
The General Truck and Equipment Company of St. Paul, Minnesota, on September 12, 1952, sold and delivered to defendant Carl Handler one 1952 GMC truck and van for $7,651.81 upon terms and conditions set forth in a conditional sales contract. Defendant C. A. Wolk executed a written guaranty by which he guaranteed payment of all sums to be paid by Handler under the contract. The conditional sales contract and the guaranty was thereafter, for value, assigned to plaintiff, Yellow Manufacturing Acceptance Corporation, and these instruments and the assignment were duly recorded in…
