MEMORANDUM OPINION
ROBERTS, District Judge.
This class action was instituted on September 16, 1966, by the named plaintiffs complaining of a simple breach of contract by Defendants Growth Programs, Inc., (Growth) Supervised Investors Inc., (Supervised) and two other defendants who were subsequently dropped by stipulation. 1 The scope of the lawsuit was expanded on December 8, 1967, when the Plaintiffs’ class, which had originally been confined to residents of San Antonio, Texas, was re-defined as “all persons holding single investment programs issued by Growth Programs, Inc.”, and then again in…
