Before the Court are cross-motions for summary judgment in a collective action brought under the Fair Labor Standards Act of 1938, as amended, 29 U.S.C. § 201 et seq. (“FLSA”), also involving supplemental claims under the New York Labor Law (“NYLL”). Plaintiffs, who are former waiters at a Manhattan restaurant called “Le Bateau Ivre,” operated by defendant New York Hospitality Group, Inc.
