This is a motion for judgment for money brought by Mrs. Helen Parrish Tritton against H. E. Riggsby and A. P. Franklin.

The terms, pMntiff and defendants, will be used here as they were in the trial court.

In the day time, and on October 4, 1922, Mrs. Tritton was a passenger in a jitney driven by Riggsby. She was going east on Franklin street in the city of *906Richmond and on the south side thereof, and was Struck at its intersection with Jefferson street by Franklin who was driving a one-ton truck and who was himself going south on that street and on the west side thereof.
