People ex rel. Koetteritz v. Board of Supervisors

Certiorari issued out of the Supreme Court and attested on the 15th day of April, 1911, directed to the board of supervisors of Herkimer county, commanding said board to certify and return to the office of the clerk of the county of Herkimer all and singular its proceedings had relative to the account and claim of the relator.

The petition and return raise no controversy over the material facts to be considered.
In the year 1909 several pieces of State and county road in the county of Herkimer were in process of construction in pursuance of contracts with the State Engineer, and among others a strip of the Herkimer-Middleville road by one Daniel F. Strobel. Complaints were made by substantial citizens of the county to the district attorney that the contractors were not performing their contracts and were defrauding the public, and he deemed it wise to make an investigation for the purpose of ascertaining…
