Opinion

Carman, Chief Judge:

Defendant moves for summary judgment pursuant to U.S. CIT R. 56, contending the United States Customs Service (“Customs”) properly classified the merchandise at issue under subheading 0202.30.60, of the Harmonized Tariff Schedule of the United States (“HTSUS”). Plaintiff opposes the government’s summary judgment motion, contending genuine issues of material fact exist in this matter which preclude this Court from granting defendant’s motion. The Court has jurisdiction over this matter pursuant to 28 U.S.C. § 1581(a) (1988).
