Appellee filed a complaint in an action of forcible detainer to recover certain lands in the complaint described, and on trial a finding and judgment was rendered for the plaintiff. Appellee was in possession of a certain tract of land a part of an island in the Mississippi river, which, as originally surveyed by the government, was surveyed as being in Illinois, and the land of which plaintiff was in possession was a tract on the west side of said island.
