This was an action of forcible entry and detainer brought by Bruyn against Brooks, to recover possession of the 3ST. W. 9, T. 9 bh, range 2 W, in Warren county.
The plaintiff proved that on the night of the first day of July, he went on the land in controversy with some men and two teams loaded with lumber; that they got there about ten or eleven o’clock at night; left the lumber on the land and went to. a neighboring house and slept that night.
