On June 13th, 1919, the plaintiff in error, Epstein Brother, a corporation, commenced a common law action in assumpsit in the Circuit Court of Levy County, against Wilfred C. Clarkson and Max Strauss, as co-partners doing business under the firm name and style of "Florida Crushed Rock Company," defendants. The defendant Strauss made no defense to the action, but the defendant Clarkson appeared and on the Rule Day in August, 1919, filed six pleas to the plaintiff's declaration.
