By agreement of the parties, this case is submitted to the court, on the following-questions of law, viz.:

1 ‘ First. Whether under the agreement between the com plainants and the respondent corporation, annexed to the bill as Exhibit A, the complainants are or not entitled to receive from the assignee of the National Rubber Company a dividend upon the whole amount of the advances made by them to said Rubber Company and unpaid from the proceeds of goods sold at the time of the company’s assignment, or only on the balance, if any, that might thereafter be found to be due after crediting the…
