Following a notice-and-comment rule-making procedure, the Federal Communications Commission (“FCC,” “Commission,” or “the agency”) released an order (“the Order”) adopting rules interpreting and implementing section 621(a)(1) of the Communications Act of 1934 (“the Act”), 47 U.S.C. § 541(a)(1), which prohibits local franchising authorities from “unreasonably refus[ing] to award” competitive cable franchises.
