Action in the district court for Polk county, to recover the sum of $5,000 for personal injuries. The action was tried before Watts, J., and a jury, which rendered a verdict for the defendants. From an order denying a'motion for a new trial plaintiff appealed.

This is an action to recover damages for personal injuries alleged to have been received by plaintiff by falling into an unguarded and unprotected sewer trench in one of the streets of *75the city of Crookston. Defendants had a verdict in the court below, and plaintiff appeals from an order denying a new trial.
