KNAPPEN, Circuit Judge.
Complainant filed its bill to restrain infringement of an alleged common-law trade-mark, consisting of the word “Eagle” and the picture of an eagle as applied'to snuff of its manufacture. There is no charge of unfair competition. On final hearing on pleadings and proofs the District Court dismissed the bill. From that dismissal this appeal is taken. Defendant appeared below, filed an answer, and (except as presently stated) was represented by counsel throughout, including final hearing.
