OPINION
IRENAS, Senior District Judge:
This employment discrimination action appears before the Court on Defendants’ Motion to Dismiss Plaintiffs Second Amended Complaint for failure to state a claim upon which relief can be granted pursuant to Rule 12(b)(6).1 For the rea*471sons below, the Motion will be DENIED in part and GRANTED in part.
