This case is before us for the third time in four years. In Ewing v. NLRB, 732 F.2d 1117 (2d Cir.1984) {“Ewing I”), we reversed the National Labor Relations Board’s (“NLRB” or “Board”) finding that Herbert R. Darling, Inc. (“Darling”) did not discriminate against Robert Ewing when it refused to rehire him in the mistaken belief that he had filed a complaint with the Occupational Safety and Health Administration (“OSHA”).
