This action is brought by the defendant in error, against the plaintiff in error, and other defendants, who were subsequently dismissed, and the case proceeded alone against the plaintiff in error, to recover damages for the wrongful death of the son of defendant in error. Hereinafter the parties will be designated as they were in the trial court.
