1Opinion of the CourtDunn, J.
(after stating the facts as above). Six assignments of error are discussed in the brief of plaintiff in error. The first is: “The court erred in overruling the demurrer of plaintiff in error to the evidence offered by defendant in error.” And in this connection it insists there was a variance between the allegations and the proof. The balance of the assignments relate to the alleged errors in the instructions given by the court to the jury.
