OPINION OF THE COURT

FULTON, Senior Judge:

On trial before a general court-martial for wrongfully selling cocaine twice at an American military installation in Germany, and conspiring to sell and wrongfully transferring cocaine on another occasion, McDonagh contested the court’s jurisdiction over him as a person subject to the Uniform Code of Military Justice. He asserted that his enlistment was void because it had been accomplished with the fraudulent assistance of a recruiter and that, as a result, he was not subject to in personam jurisdiction in view of the doctrine announced by the Court…
