This appeal is by the defendant from the judgment entered upon a verdict recovered by the plaintiff in the sum of $2,500 as damages for personal injuries suffered by him when struck by an automobile owned by the defendant and driven by one Guise. It was averred in the statement, and denied in the affidavit of defense, that at the time of the accident Guise was the agent and servant, and engaged in the performance of the business, of the defendant.
