BRUGGINK, Judge.

In American Satellite Co. v. United States, 26 Cl.Ct. 146 (1992) (hereafter “ASCI”), this court granted defendant’s motion for summary judgment as to the three counts then remaining in this proceeding. That decision was reversed in part, vacated in part, and remanded by a decision of the United States Court of Appeals for the Federal Circuit. American Satellite Co. v. United States, 998 F.2d 950 (Fed.Cir.1993) (hereafter “ASC II”).
