The defendant, Derek John Cobum, appeals from the judgment of the trial court in favor of the plaintiffs, Terrance J. O’Brien and Mary Ann O’Brien, in this action for an easement. The defendant claims that the trial court improperly (1) permitted the plaintiffs to amend their complaint, (2) denied his application for attorney’s fees, (3) denied the recusal motion that was made during the course of trial, (4) refused to reread testimony during his cross-examination of a witness, and (5) admitted hearsay testimony under General Statutes § 52-172, the dead man’s statute.
