— The following contract was entered into between these parties:

“State of Texas, County of Harris.

“Memoranda of an agreement made and entered into this 23d day of February, 1907, by and betw-een John O’Neil of Houston, Harris County, Texas," party of the first part, and the Sun Company, a corporation, of Beaumont, Texas, party of the second part, in which said first party represents that he has a good and sufficient title to a certain acre tract of land located in the Echols tract at Humble, Texas, as hereinafter described, and in which said second party is desirous of…
