MEMORANDUM OF DECISION RE: MOTION TO DISMISS

On June 19, 2001, the plaintiff, Carlos Avila, filed a complaint against the defendant, Joseph Eannuzzi. The plaintiff alleged that the defendant operated his motor vehicle negligently and recklessly, resulting in a collision that occurred on or about June 4, 1998, in which the-plaintiff was injured.
