OPINION

SWEET, District Judge.

Defendant Morton Cohn (“Cohn”) has moved for summary judgment to dismiss the class action complaint of plaintiff Del Dietrich (“Dietrich”) as to Cohn, pursuant to Federal Rule of Civil Procedure 56. Dietrich has opposed the motion and has moved to strike certain evidence presented by Cohn in support of his motion for summary judgment. For the reasons set forth below, the motion for summary judgment is denied, as is the motion to strike.
