LAND, Justice.
The five defendants were jointly indicted for the kidnapping of one Jeff Davis, under Act No. 221 of 1932, by forcibly seizing him and carrying him from one part of the parish of Tangipahoa, state of Louisiana, to another part of the same parish, “to-wit: From the Town of Kentwood, Louisiana, in the Parish of Tangipahoa to or near a place about two miles northwest of the Town of Kentwood, known as the Old Ellis Place.”
After the jury was impaneled, but' before trial, the state entered a nolle prosequi as to the defendant Herman McMillan.
