The defendants Berry and three others were charged, as follows, by two counts in an information filed in the superior court for Thurston county, with the crimes of kidnaping in the first degree and of assault in the first degree:

“They, the said K. W. Berry, William McAloon, James Reddick and Robert Smith, in the county of Thurston, State of Washington, on or about the 19th day of August A. D., 1938, did wilfully, unlawfully and feloniously, seize, confine and inveigle another, to-wit, one Irving Baker, with intent to cause the said Irving Baker without authority of law to be secretly confined…
