■ This is a suit instituted for the use of a sub-contractor, the Otis Elevator Company, to recover on a surety bond executed to secure the performance of a construction contract entered into between the nominal plaintiffs, Eleanor Davis Harris and others, and the principal contractor, the Good Construction Company. The question presented is whether recovery may be had for the use of the sub-contractor, though he is not a party to either the main contract or the surety bond.
