The appeal is from an order denying defendant a new trial after a verdict of guilty of robbery in the first degree.

We state the facts substantially as told by defendant when testifying. He knew Gilbert Peterson, an ex-convict, and drove around Minneapolis with him on the Saturday before Labor day, September 2, 1929. While so driving they met with one Capinie, the St. Paul collector for the Pure Oil Company, a corporation owning and operating chains of gasolene filling stations in the Twin Cities.
