OPINION

ANDERSON, Chief Judge.

Respondent Franz Engineering Reproductions, Inc. (Franz Engineering) sued appellant Gerber Scientific Instrument Company (Gerber), seeking damages for breach of warranties and violations of the Minnesota Con sumer Fraud Act. The trial court dismissed Franz Engineering’s consumer fraud claims, but denied Gerber summary judgment on the breach of warranty claims. The court also denied Gerber’s motions to exclude certain evidence.

Before submitting the matter to the jury, the trial court ruled that Gerber and Franz Engineering’s contract excludes consequential damages…
