MANION, Circuit Judge.
Scott Stevens, a resident of the Oneida Indian Reservation near Green Bay, Wiscon sin, was involved in a fight in a Green Bay night club which the police quelled. The police took Stevens to a public telephone to call a cab. Ninety minutes later, in the early morning of October 28, 1998, a car struck and killed Stevens while he walked in the middle of a street in Green Bay. His blood alcohol level at the time of his death was .237 grams of alcohol for every 100 milliliters of blood.
