This suit has been brought to this court by writ of ■ error proceedings from the district court of Wichita county. The writ of error was sued out by Ogda De Proy and August De Proy, widow and son, respectively, of John De Proy, deceased. They were defendants in the trial court, and will hereinafter be designated as defendants. August D. Progakis was plaintiff in the trial court, and will hereinafter be referred to as plaintiff.
