Appellant, A. B. Gardner, and appellee, Randell, about the first of February, 1883, agreed to purchase the lot in controversy, which is situated in the city of Denison and has upon it a brick store house. Each was to-pay one-half of the purchase money and were to hold equal interests in the property. In pursuance of the agreement, appellant went to Colorado City to make the purchase, appelleehaving handed him ten dollars to pay in part his expenses.
