Per Curiam :

This case was referred pursuant to Rule 45 to Saul R. Gamer, a trial commissioner of this court with directions to file with his findings of fact recommendations for conclusions of law which the commissioner has done in a report filed May 6,1960. On June 16,1960, defendant filed a motion requesting that the court adopt the report of the commissioner as the basis for the entry of judgment, the plaintiff having failed to file within the 15-day period required by Rule 46(a) a notice of intention to except to the commissioner’s findings and recommendation.
